CHICAGO (AP) — America’s obesity epidemic is proving to be as stubborn as those maddening love handles, and shows no sign of reversing course. More than one-third of adults and almost 17 percent of children were obese in 2009-2010, echoing results since 2003, the Centers for Disease Control and Prevention reported Tuesday.

“It’s good that we didn’t see increases. On the other hand, we didn’t see any decreases in any group,” said CDC researcher Cynthia Ogden.

Early in the decade, slight increases were seen among white, black and Hispanic men, and among Hispanic and black women. These changes may be leveling off, but the authors said they “found no indication that the prevalence of obesity is declining in any group.”

In 2009-2010, more than 78 million adults and almost 13 million children aged 2-19 were obese, the CDC researchers reported.

Those numbers are staggering, and while they haven’t increased in recent years, “we’re plateauing at an unacceptably high prevalence rate,” said Dr. David Ludwig, director of an obesity prevention center at Children’s Hospital Boston. He was not involved in the reports.

The CDC reports summarize results of national health surveys in children and adults, which are conducted every two years. The nationally representative surveys include in-person weight and height measurements. The 2009-2010 reports involved nearly 6,000 adults and about 4,000 children, from infancy through age 19.

The results were released online in the Journal of the American Medical Association.

Dr. Elbert Huang, an associate professor of medicine at the University of Chicago who studies health care policy issues, said his research shows that even if obesity rates continue to remain stable, there will be dramatic increases down the road in diabetes and in costs linked with that disease. That’s because Type 2 diabetes, among many diseases linked with obesity, becomes more prevalent as people age.

The latest reports — one on children and the other on adults — focused on obesity, meaning a body-mass index of at least 30. But the numbers of adults and children who were overweight, with a BMI of between 25 and 29, also remained high.

Overall, 33 percent of adults were overweight but not obese, versus about 15 percent of children and teens.

Rates of overweight or obese adults and children were generally higher in blacks and Hispanics than in whites.

The government says a healthy weight is a BMI of between 18 and 25. The index is a ratio of height to weight.

NEW YORK (Reuters Health) – Among weight-loss surgery options, gastric bypass comes with more complications shortly after surgery than gastric banding, but makes up for it with fewer long-term side effects and repeat operations, new research suggests.

People who got bypass surgery also lost weight faster, and more kept it off, in the study of more than 400 obese Swiss patients.

“What we would like with any of the (weight-loss) procedures ideally would be to have the least long-term complications, certainly the least long-term complications requiring (repeat) surgery,” said Dr. Michel Suter, a surgeon from the Hopital du Chablais, Aigle, who worked on the study.

“There are drawbacks with bypass, there are side effects, and we have to take them into account,” he told Reuters Health. But “overall, if I had to choose between the procedures, I certainly recommend the bypass.”

Still, one researcher not involved in the study said that when complications do happen with gastric bypass, they are often more serious than complications after banding.

Suter and his colleagues looked back at records of 442 obese patients who underwent weight-loss surgery at their hospitals between 1998 and 2005.

To qualify for surgery, all patients had to have a body mass index — a measure of weight in relation to height — of at least 40, or at least 35 if they also had an obesity-related illness. That’s the equivalent of a five-foot, six-inch person weighing at least 248 pounds or 217 pounds, respectively.

Half of the patients had gastric band procedures, which involve placing a band around the top of the stomach to limit its size to a small pouch. The other half were treated with gastric bypass, when part of the stomach is stapled off and then rerouted to bypass a segment of the small intestine. The two groups were similar in terms of their age and initial weight.

Doctors checked in with those patients at least twice a year for the next six years post-surgery.

Complications in the month after the procedure — which typically include infections — were more common after gastric bypass than after banding: 17 percent of bypass patients had any surgery-related problems, compared to five percent in the banding group.

“The operation itself is a little more complicated and a little more risky,” Suter explained.

But after that point, the bypass group lost weight faster, put less of it back on and suffered fewer long-term complications, including those that called for a repeat procedure.

Six years post-surgery, 12 percent of bypass patients had a body mass index above 35, considered severely obese, compared to one-third after gastric banding.

And thirteen percent of patients needed re-operation after complications with gastric bypass, versus close to 27 percent following banding.

The long-term complications of gastric banding were generally related to the band eroding and needing to be removed, food intolerance or stretching of the esophagus, the researchers reported Monday in the Archives of Surgery.

With gastric bypass, patients most often had internal hernias, a type of bowel blockage that can be life-threatening if not treated.

‘NOT ALL COMPLICATIONS ARE ALIKE’

Dr. Christine Ren-Fielding, a weight-loss surgeon at the New York University School of Medicine, said that her research has suggested gastric bypass complications tend to be much more serious than complications related to banding.

“We all know that not all complications are alike,” Ren-Fielding, who was not involved in the new study, told Reuters Health by email. “For example a wound infection treated with antibiotics is not the same as a…leak which requires re-operation and extended hospitalization.”

While Ren-Fielding said banding has been found to be “a relatively safe procedure,” technique and surgeon experience can affect outcomes of any surgery.

Weight-loss surgery typically costs around $ 20,000. Gastric banding may be cheaper than bypass initially because of a simpler procedure and shorter hospital stay — but Suter said that the need for band adjustments over time may drive up costs.

When it comes to choosing a procedure, Ren-Fielding said, “My philosophy is one of helping the patient be successful and optimizing outcomes, regardless of which operation they have, because all bariatric surgeries have their overwhelming benefits in treating the disease of obesity.”

“I’m not at a point when I would say, ‘No way’ to a patient who asks for a band and has no contraindications to the band,” Suter said.

Still, he added, “I discourage them to have a band because I don’t want to operate on them two or three times — one time is enough. Bypass is more definitive.”

CINCINNATI (AP) — Two former attorneys serving prison time for scamming their clients of $ 94.6 million from a $ 200 million settlement over the diet drug fen-phen may have a valid point about the trial judge making an error, but “it looks wrong” that they took the bulk of the settlement for themselves, a federal appeals court judge said Tuesday.

Judge Ronnie Lee Gilman of the U.S. 6th Circuit Court of Appeals in Cincinnati told attorneys that the way 60-year-old William Gallion and 57-year-old Shirley Cunningham Jr. handled the 2001 settlement, including distributing only $ 40 million to clients initially, doesn’t help their cause.

“They lawyers are getting 75 percent of the settlement and the clients are getting 25 percent,” Gilman said.

Gallion and Cunningham were convicted of scamming more than 400 clients out of millions they had won against American Home Products. Fen-phen was pulled from the market after users had heart problems related to the drug. Prosecutors say they illegally kept the bulk of the settlement, but made more money available to their clients after the federal government began a criminal investigation.

The panel took the case under advisement and did not issue an immediate ruling.

Cunningham’s attorney, Clifton Harviel, told the judges that U.S. District Judge Danny C. Reeves made multiple errors during the trial, depriving the men of a fair trial.

Gallion’s attorney, Louis Sirkin, told the panel that Reeves allowed jurors to see 22 findings made by the Kentucky Supreme Court against Gallion and Cunningham, even though the high court never held a hearing.

“It changed the whole dynamic,” Sirkin said. “It made these people look like bad guys.”

Judge Eric Clay wasn’t impressed with the argument.

“You go on and on, but we’re not hearing any legal authorities,” Clay said.

“We’re doing the best we can,” Sirkin replied.

Vijay Shanker, an attorney with the U.S. Department of Justice, recounted some of the evidence in the case, including how Gallion and Cunningham instructed employees not to tell clients the full details of the settlement and offer them less than they were initially allocated. Shanker also told the panel how Cunningham funneled $ 153 million into the attorneys’ accounts, then put $ 59 million back into the settlement after the federal government issued subpoenas as part of an investigation.

“The evidence in this case was, in a word, overwhelming,” Shanker said.

Shanker also noted that jurors saw only a few of the findings by the Kentucky Supreme Court and were later instructed to disregard what they had been shown.

“The full list of allegations was never shown to the jury,” Shanker said.

The case has swallowed not only the careers of Gallion and Cunningham, who were prominent attorneys in Lexington and one-time owners of champion racehorse Curlin, but also of Melbourne Mills, who was acquitted at trial, but later disbarred for his role in the case. The Kentucky Supreme Court also has disbarred former state judge Joseph P. “Jay” Bamberger, who oversaw the settlement and later profited from it, as well as David Helmers, a former legal associate of Gallion.

The Kentucky Supreme Court is also weighing the future of class-action specialist Stanley Chesley of Cincinnati. Chesley avoided criminal prosecution, but faces multiple ethics charges that could result in his being disbarred.

Gallion and Cunningham are also being pursued by their former clients in civil court. In a lawsuit, a judge awarded the former clients $ 42 million, but the Kentucky Court of Appeals overturned the decision and the case is pending with the Kentucky Supreme Court.

A related civil case against Chesley is pending.

Gallion is not scheduled to be released from federal prison until 2029; Cunningham won’t get out until 2025.

MONDAY, Jan. 9 (HealthDay News) — There’s limited evidence that
any particular diet or supplement helps kids with
attention-deficit/hyperactivity disorder (ADHD), but at least some
research suggests that omega-3 fatty acids may help while fatty
“Western-style” diets do these children no favors.

Researchers from Children’s Memorial Hospital in Chicago reviewed
previous studies on diets and supplements that have been tried in children
with ADHD. Among the diets tested: restricting sugar, which some parents
believe worsens hyperactivity; avoiding food containing additives and
preservatives, known as the “Feingold diet“; an “elimination diet” that
avoids foods most often implicated in food allergies; and supplementing
with omega-3 fatty acids, such as fish oil capsules.

Little research supports the idea that sugar or artificial sweeteners
affect children’s behavior, according to the review. Nor is there much
evidence from controlled trials to support the Feingold diet, which first
became popular in the 1970s and advocates avoiding food that contains red
and orange dyes and preservatives (including apples, grapes and lunch
meats).

Yet, some studies have suggested some kids with ADHD benefit from an
elimination, also known as a hypoallergenic, diet. But that typically
means forgoing cow’s milk, cheese, wheat cereal, eggs, chocolate, nuts and
citrus foods, which can be tough on the child and on the family, said
study author Dr. J. Gordon Millichap, a professor emeritus at Northwestern
University Medical School and neurologist at Children’s Memorial Hospital
in Chicago.

Moreover, the results of studies on hypoallergenic diets have been
mixed. “We find the hypoallergenic diet might be effective, but difficult
for families to manage them,” Millichap said.

One study by Australian researchers suggested that kids who ate a
typical “Western-style” diet that’s high in fat, salt and refined sugars
had a higher risk of ADHD than kids who had a healthier diet that was rich
in fish, vegetables, fruit and whole grains and that contained lots of
fiber, folate and omega-3 fatty acids.

Dr. Roberto Lopez-Alberola, an associate professor and chief of
pediatric neurology at University of Miami School of Medicine, said he
strongly advocates children with ADHD following such a healthier diet and
avoiding dyes, preservatives and other additives.

Though the precise biological mechanism hasn’t yet been uncovered,
Lopez-Alberola believes the increase in obesity rates and in ADHD are not
unrelated, and unhealthy modern diets may be contributing to the
problem.

“I am a firm believer that we ultimately are what we eat, and
unfortunately as a result of our poor Western diet, we see this in the
increase in the rate of obesity, particularly in the young population,”
Lopez-Alberola said. “The fast foods. The processed food. The
preservative-rich foods . . . In the same way we see an impact physically,
it’s going to have an impact from the neurodevelopmental standpoint. It’s
not surprising we see a parallel in the increase in obesity and in
ADHD.”

Another study, conducted by researchers in England in children who were
excessively clumsy — some of whom also had ADHD — found that omega-3
supplements didn’t help with motor skills, but did seem to help with
attention.

Other research has found that many kids with ADHD had unusually low
levels of iron in the blood. One Israeli study found that the parents of
kids given iron supplements reported less ADHD symptoms in their kids, but
teachers saw no such effect.

Therein lies much of the problem with research that looks at dietary
interventions for ADHD, said Dr. Andrew Adesman, chief of developmental
and behavioral pediatrics at Steven & Alexandra Cohen Children’s
Medical Center of New York.

The placebo effect can be powerful. Much of the research on dietary
interventions compares dietary interventions to no treatment, while
there’s little research that compares a diet to stimulant medications such
as Ritalin (methylphenidate) or Adderall (dextroamphetamine and
amphetamine), which have decades of research showing that they’re
effective in kids with ADHD, Adesman said.

“For better or worse, medications are the single most effective
treatment available for ADHD,” Adesman said. “We don’t have data to
suggest dietary interventions are any more effective than medications, and
there is little, if any, data to suggest dietary interventions are
as effective as medications.”

The review is published in the February issue of Pediatrics.

ADHD affects an estimated 5 percent to 8 percent of school-aged
children. Symptoms, which often persist into adulthood, include
inattention, hyperactivity and impulsivity beyond what’s normally seen,
given a child’s age and development.

Understandably, many parents are reluctant to medicate their young
children, and so there’s lots of interest in alternative treatments,
experts said.

“We do find parents are becoming more interested in the possibility of
using diets rather than, or as a complement to, medication,” Millichap
said.

While the first line of treatment for ADHD is medication and behavioral
therapy, which uses positive reinforcement to help kids learn to control
impulsivity, parents who want to try dietary interventions should be
supported in their efforts, Millichap said.

“Diets can be used in the treatment of ADHD, but it’s usually not a
first choice with most parents,” he said. “But some parents prefer it and
don’t like medications at all. That’s one of the reasons for considering
the diets. Another is if there are side effects or adverse effects from
the medications. Then one might turn to dietary treatments.”

Added Adesman: “Families are welcome to explore and pursue alternative
approaches, but they need to recognize that oftentimes there is limited
research to support or justify their use and the benefits will likely be
less substantial than conventional treatment.”

Dr. Daniel C. Batchelor, Overall winner of the Subaru Challenge Triathlon and SIx Flags Half Marathon. #1 ranked- 2010 Georgia State Championship Mountain Bike Race Series XC-GM July, 2010. 6 time overall winner of the Roswell Road Race.
Dr. Batchelor was recently interviewed on national CNN headline news as Atlanta’s expert on athletic injury and back pain rehabilitation.

Recently, the A&E Channel came to the Batchelor Clinic for 4 hours. Dr. Batchelor is the treating doctor for a 350 pound Roswell Georgia man that has been unwilling to acknowledge the fact that he needs to lose weight or have himself examined and treated for a variety of conditions related to his obesity. His family intervened and convinced him the need for professional care. The A&E channel was there every step of the way as they filmed Dr. Batchelor’s entire consultation, examination and treatment of the 350 pound Roswell man. The documentary will be televised within the next month on the A&E channel.

He is an actor in an upcoming movie “Against the Wind”, soon to be released into a theater near you. He is a supporting actor playing the part of a fighter pilot that later becomes a Federal DEA undercover agent sent to eliminate leaders of a major illegal drug(opium) organization. The movie was filmed in the jungles of Costa Rica and Nicaragua and in Malaysia and in the mountains of North Carolina.

Dr. Batchelor is a monthly columnist on Sports Medicine for several fitness magazines and has spoken to dozens of clubs and lectured to many medical colleges on Sports Medicine.

Dr. Batchelor has run over 60,000 miles, biked over 250,000 miles and has treated over 100,000 patients including many beginning as well as Olympic athletes from all over the world.

Recent invited quest speaker for the Huntsville Rocket City Marathon(voted as one of the top 10 marathons in the USA by Runners World).
